Terms & Conditions: no catches, just keeping it real

Welcome to the swiftshieldz online (swiftshieldz​ site​). By accessing or using the swiftshieldz site,  however, accessed, you agree to be bound by these terms of use which comprise the legal terms  and conditions, the E-commerce terms and conditions including Return (Refund)/ Exchange Policy,  the Cancellation Policy and the Privacy Policy ​(Terms of Use​). These Terms of Use affect your legal  rights and obligations.

SwiftShieldz​ ​reserves the right to make changes to the SwiftShieldz​ ​site and its Terms of Use at any  time. Each time you use the SwiftShieldz​ ​site you should visit and review the then current Terms of  Use that apply to your transactions and use of this site. If you no longer accept these Terms of Use,  or any future modifications to these Terms of Use, you must cease using SwiftShieldz site.  Continued use of the site indicates your continued acceptance of these Terms of Use. If, for any  reason, we believe that you have not complied with these Terms of Use, we may, at our sole  discretion, cancel your access to the registration areas of the SwiftShieldz site immediately and  without prior notice.

Tampering with the SwiftShieldz​ ​site, misrepresenting the identity of a user, using buying agents and  conducting fraudulent activities on the SwiftShieldz site are expressly prohibited.

By using the SwiftShieldz​ ​site, you expressly agree that use of the SwiftShieldz site is at your sole  risk. Neither the SwiftShieldz​ ​site nor its parent company, affiliates, subsidiaries or designees nor  each of their respective officers, directors, employees, agents, third-party content providers,  designers, contractors, distributors, merchants, sponsors, licensors or the like (collectively,  Associates​) warrant that use of the SwiftShieldz​ ​site will be uninterrupted or error-free. Neither the  SwiftShieldz​ ​site nor its Associates warrant the accuracy, integrity or completeness of the content  provided on the SwiftShieldz​ ​site or the products or services offered for sale on the SwiftShieldz​ ​site.  No oral advice or written information given by the SwiftShieldz​ ​site or its Associates shall create a  warranty.

Under no circumstances shall the SwiftShieldz​ ​site or its Associates be liable for any direct, indirect,  incidental, special or consequential damages that result from your use of or inability to use the  SwiftShieldz​ ​site, including but not limited to reliance by you on any information obtained from the  SwiftShieldz​ ​site that results in mistakes, omissions, interruptions, deletion or corruption of files,  viruses, delays in operation or transmission, or any failure of performance. The foregoing Limitation  of Liability shall apply in any action, whether in contract or any other claim, even if an authorized  representative of the SwiftShieldz​ ​site has been advised of or should have knowledge of the  possibility of such damages. User hereby acknowledges that this paragraph shall apply to all  content, merchandise and services available through the SwiftShieldz site.

The SwiftShieldz​ ​site attempts to display product images shown on the site as accurately as  possible. However, we cannot guarantee that the color you see matches the product color, as the  display of the color depends, in part, upon the monitor you are using. 

Prices and availability of products and services are subject to change without notice. Errors will be  corrected where discovered, and the SwiftShieldz site reserves the right to revoke any stated offer  and to correct any errors, descriptions, specifications, inaccuracies or omissions including after an  order has been submitted and whether or not the order has been confirmed and your credit card  charged. If your credit card has already been charged for the purchase and your order is cancelled,  the SwiftShieldz site will issue a credit to your credit card account in the amount of the charge.  Individual bank policies will dictate when this amount is credited to your account.

Online prices and selection generally match those in our stores, but may vary. Prices and offers are  subject to change but will not be changed on any order that SwiftShieldz has accepted.

Prices for Products exclude delivery costs, which if applicable will be added to the Customer Invoice  in accordance with our current pricing structure (available on request).

It is agreed that the Prices are inclusive of Value Added Tax (VAT). Where VAT is payable by  SwiftShieldz the agreed consideration for the supply shall include the amount of VAT payable  applicable at the prevailing rate at the time the supply is made as a result of applicable legislation in  the United Arab Emirates.

You may pay for your order with the following methods:

1. Credit/Debit card Online –​ Generally, credit and debit cards are not charged until we either  ship the item(s) to you or confirm store availability (at which time you will be charged only  for the goods which actually have shipping charges). However, we may pre-authorize your  order amount with your credit or debit card issuer at the time you place the order, which may  have an effect on your available credit line. When paying for a pre-order with a debit card you  will be charged at the time you place your pre-order. Please contact your credit card issuer  for more information. If an order is placed by credit card and the order is cancelled for  permitted reasons, the money will be automatically credited back to your bank. This usually  takes 10-20 days after SwiftShieldz has initiated the refund, depending on your bank.

2. Bank Transfer​- If you have made a bank transfer and the order has been cancelled due to  permitted reasons, we will offer an online voucher with the same value which can be  redeemed online. No cash refunds will be provided.
3. Cash on Delivery​- If you have made a cash payment and the order has been cancelled due to  permitted reasons, we will offer an online voucher with the same value which can be  redeemed online. No cash refunds will be provided.

Refunds are subject to timelines from customer’s bank, and SwiftShieldz will not be responsible  for any delays once the refund has been issued to the bank from SwiftShieldz.
Note: For all refunds only the value of the item will be refunded and not the shipping charges.

Unlike credit or debit cards, Promotional Codes used on Digital Coupons are debited at the time an  order is placed. Digital Coupons will automatically be redeemed to purchase totals, up to the total  purchase amount. Digital Coupons must be used prior to their noted expiration date and within a  single transaction. Coupons cannot be replaced if lost, stolen, deleted, or if you cancel or return your  purchase. In the event of a reduction in price below the coupon value, the excess value of the  coupon will not be refunded. Digital coupons and vouchers can be used only on the SwiftShieldz  site.

Store Credit is added to the account for any refunds, this will be valid for 6 months and can be used  for any purchase online. If you do not wish for the credit to be added to your account, kindly let us  know during the refund process.

Store credit is issued for instances where the product is defective or for an exchange.

After you place an order using our shopping cart, we will check the information you give us for  validity, by verifying your method of payment or shipping address. We reserve the right to reject any  order you place with us, and/or to limit quantities on any order, without giving any reason. If we  reject your order, we will attempt to notify you using the e-mail address you have given us with the  order.

Your credit or debit card will normally not be charged if we reject an order, but we will process a  refund if the charge has been made against your card.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of  your order, nor does it constitute confirmation of our offer to sell. The SwiftShieldz site reserves the  right at any time after receipt of your order to accept or decline your order for any reason.

SwiftShieldz may, at its own discretion, limit or cancel quantities purchased per person, per  household or per order. The SwiftShieldz site also reserves the right to reject any order you place  with us. These restrictions may include orders placed by the same SwiftShieldz site account, the  same credit card, and orders that use the same billing and/or shipping address. In the event we  make a change to an order, we will attempt to notify you by contacting the e-mail and/or billing  address provided at the time the order was made. The SwiftShieldz site reserves the right to limit or  prohibit sales to dealers.

Shipping costs are based on a combination of the following:
Weight and dimensions of your package;
Method of shipment (ground,air,sea, rail etc.);
Location you are shipping from (city, state, country);
Location you are shipping to (the destination country).

We also offer free shipping within the UAE, for orders of AED 500 and above. Shipping costs to other  countries will be calculated on your shopping cart during checkout.

Costs can be considerably higher for international destinations, and generally not include additional  charges such as duties, taxes, and customs clearance fees. For example, international rates may  include pickup and door-to-door delivery. Extended Area Surcharges may apply depending on the  international location and is not included in the shipping fees. This should be paid by the customer  receiving the goods.

We have our own courier for deliveries to Dubai and Sharjah, but use Fedex for deliveries to all other  Emirates and for international orders.

Within the UAE: 24-48 hours
Within Dubai & Sharjah: 24 hours
All other Emirates: 48 hours
Within the GCC: 3-7 days
All other international destinations: up to 10 days.

In case we receive a cancellation notice and the order has not been shipped, we shall cancel the  order and refund the entire amount. The refund process would take 10 to 30 days and would be  reimbursed to your credit card. We will not be able to cancel orders that have already been shipped.  The customer agrees not to dispute the decision made by SwiftShieldz and accepts the cancellation  policies. For bank transfer order, if payment is not received in 3 days the order will be cancelled  automatically.

SwiftShieldz may, in its sole discretion, terminate your account or your use of the SwiftShieldz site  at any time. You are personally liable for any orders that you place or charges that you incur prior to  termination. The SwiftShieldz site reserves the right to change, suspend or discontinue all or any  aspects of the SwiftShieldz site at any time without prior notice. 

The Consumer Code of Rights was issued under UAE Federal Law (24) 2006 by the Ministry of  Economy (MoE). In Dubai, the Department of Economic Development’s (DED) Commercial Control  and Consumer Protection vision has been charged with the responsibility to ensure that consumers  and retailers alike comply with the Consumer Code of Rights, understand their responsibilities and,  where resolution is sought, facilitate this process between retailers and consumers.

These Terms and Conditions shall be interpreted and governed by the laws of the United Arab  Emirates. Each party agrees to submit to the jurisdiction of the courts of Dubai and to waive any  objections based upon venue. SwiftShieldz may select to pursue any dispute in any court as it  determines in its sole discretion.

Refunds will be done only through the Original Mode of Payment  1. RETURN ( REFUND) /EXCHANGE POLICY:

1. If a product is found to be defective or not found to be working as per the required  specifications, the customer shall take the product to the nearest SwiftShieldz shop within ​7  days​ of purchase along with the original invoice in order to return or exchange.

2. Refunds for the return will be credited to your SwiftShieldz account as Store Credit, this can  be used to purchase any products on our website. Validity will be 6 Months. In any case  where you wish to receive a credit card refund you can contact our call center.

3. Products can be returned only in the country in which they were originally purchased. If the  conditions are satisfied, customer would be paid back the product price mentioned in the  invoice.

4. The product must be in its original packaging condition (including instruction manual and all  accessories), which means it is unworn, unopened from shrink wrap or seal opened, unused  and in its original condition. If the conditions are satisfied, customer would be credited Store  credit or refunded the product price mentioned on his invoice or an exchange of a product up  to the value mentioned on the invoice.

1. The customer has no right to exchange or return (refund) in the following cases:

A- The product is free from any defects which might harm customer health and safety.

B- The customer is unhappy with the product for any reason.

C- The customer found the same product or services cheaper elsewhere.

D- The customer bought the product for someone else who does not want it for any reason.

E- The customer bought the product, and after sometime they received a gift from anyone  with the same product.

F- Custom-configured and personalized products cannot be returned, refunded or  exchanged.

By reading this statement you  consent to the processing of your Information in accordance with this Privacy Policy (Policy). We will  keep this Policy under review and any changes made from time to time will be posted on this page.  This Policy sets out details of the Information we collect about you and the ways in which we may  use that Information.

Personal and/or Commercial Business information 
Information means the information/data provided by you, other personal, financial and commercial  information and the documents (including but not limited to any document, commercial paper, deed  or other form) provided in respect of all herein.

RIGHT VIEW TRADING L.L.C endeavors to collect and use your Information only with your knowledge  and consent. We may gather your Information from a purchase through your customer enquiries, via  email, through our business dealings or through our customer services team, when you request  product information or, when you register online or enter any promotions or competitions through  any channel. For web visitors, a user must first complete a registration form. During registration, the  user is required to give their contact information (such as name and email address). Demographic  and geographic Information may be requested. RIGHT VIEW TRADING L.L.C does not share any  personal or private customer/business Information submitted online with third parties other than as  set out herein. This Information will be stored, analyzed and used to assist Swiftshieldz to improve  our services.

The Information you provide on the SwiftShieldz website and/or other communication channels will  be held only by RIGHT VIEW TRADING L.L.C and its affiliates or duly authorized agents. Your  Information will not be given or sold to any outside organization for marketing purposes without your  consent.

We may disclose, share, transfer, store or process your Information to/with other companies in the  Right view group of companies, including their respective partners, agents and subcontractors, for  any relevant purposes. In addition, we may disclose your Information as may be required by law,  regulation or legal proceedings.

Data Collection and Processing 
By submitting your Information you accept that your details and related Information will be managed,  stored, transferred and processed by RIGHT VIEW TRADING L.L.C in accordance with applicable  policies and procedures which may include using third party services for such management, storage,  transfer, and/or processing. Please note that RIGHT VIEW TRADING L.L.C may provide aggregate  statistics and general Information about SwiftShieldz customers, sales, traffic patterns and related  site information to reputable third-parties, but these statistics and general information will not  include personally identifying Information. RIGHT VIEW TRADING L.L.C shall take reasonable  measures to protect any Information provided and maintain the privacy of such Information in  accordance with standard applicable practices.

Purpose of collecting Information 
The Information is used to contact the user about the services on our site for which they have  expressed interest.
If you are an swiftshieldz registered customer, we may use your Information for the purposes of: (a)  verifying that you are an authorized user if you call the swiftshieldz customer services, (b) informing  you of any service related changes affecting your purchase.
